The Crash After the Crash

It is not always possible to tell how severe the damage is from an accident until you inspect your vehicle closely. Likewise, the severity of your injuries might not be obvious until they begin showing symptoms several hours after the accident. Therefore, regarding injuries, you should go to a hospital emergency room or doctor’s office immediately after an accident, to get a thorough examination and a medical report about your accident-related injuries. Regarding vehicle damage, you should drive onto the road shoulder or into a nearby parking lot immediately after the accident to inspect the damage to your car. Of course, this assumes that your car is drivable. If you cannot drive your car after another car hits it, then your choices are to push the car onto the shoulder, if there is, or just to inspect the damage from the middle of the road, and then stand on the median or at the side of the road until the police arrive. Accidents where a passing car strikes a pedestrian who is attending to a car that has just been involved in an accident are more common than you might think. Tesla Strikes Three Men Who Were Examining the Damage to Their Car After a Fender Bender
In July 2025, Tyshan Roach was driving his Cadillac on Route 80 in Paterson when it got into a collision with a Toyota. Roach and his two passengers, Marque Williams and Clarence Fennel, Jr., got out of the car to look at the damage. The NorthJersey.com website said that both vehicles were in the left lane when the men got out to inspect them, but it did not indicate whether the drivers had moved the cars there or whether the accident occurred in the left lane. A Tesla that was passing by struck the Toyota and caused it to strike the three men. Fennel sustained fatal injuries and was pronounced dead soon after the accident. He was 36 years old. Williams and Roach were also injured, but their injuries were not life-threatening.
News reports did not say anything about whether the occupants of the Toyota or the Tesla were injured, nor did it release their names. It appears that the driver of the Tesla remained at the scene of the accident and interacted with police when they arrived to investigate.
In terms of liability for the accident, most of it probably belongs to the driver of the Tesla, who should have been able to see from some distance that there were people standing outside a disabled vehicle. The driver responsible for the original accident could also bear a share of the fault for the Tesla collision.
