Defining Wrongful Death

In New Jersey, only the deceased’s spouse, children, or parents can file a wrongful death claim. These are also the only individuals who can benefit if the lawsuit is successful. If the deceased did not have a surviving spouse, child, or parent, a personal representative of the estate can file the claim.

Statute of Limitations on Wrongful Death Claims

Wrongful death claims are governed by a statute of limitations, or time limit. In both New Jersey and Pennsylvania, that time limit is two years from the date of the death. There are some important considerations to the statute of limitations. The first is that the clock starts ticking on the day of the death and not on the day of the accident.
