Dangerous Packaging on Food Products

Product liability laws protect consumers from dangerous products. If the manufacturer of a product should have tested it more thoroughly to detect safety hazards before making it available to consumers, or if there is reason to believe that the product manufacturer knew about the hazard but failed to disclose it in safety warnings, the consumer who suffered injuries while using the product for its intended purpose has grounds for a product liability lawsuit. Some product liability lawsuits arise from prescription drugs with untested or undisclosed side effects or contraindications. Singer Gets Stitches After Injury From Glass Bottle of Salad Dressing

Carly Pearce is a country music artist who performs throughout the country. She was eating dinner in her hotel room after a performance in Holmdel, New Jersey on August 8, when she tried to pour ranch dressing from a glass bottle. When the bottle broke in her hand and sharp glass caused a cut severe enough to require stitches. The paramedics advised her to go to the hospital by ambulance to have the wound treated, which she did. The next day, Pearce posted a video on social media, showing her right hand bandaged and Pearce using her left hand to apply her makeup.

If Pearce files a product liability claim against the maker of the salad dressing, she will lbe able to ask for reimbursement of medical expenses such as the emergency room visit, the ambulance transport, and the follow-up treatment. She also would be able to collect money damages for pain and suffering and any lost wages.

Product liability lawsuits, like other personal injury lawsuits, hold the maker of the product responsible for all financial losses that the plaintiff suffered because of the defendant’s negligence. If the plaintiff’s injuries were so severe that they caused the plaintiff to take a leave of absence from work, then the plaintiff can also request compensation for lost income. In the case of the most severe injuries, the plaintiff can also request noneconomic damages to compensate the plaintiff for the non-financial ways in which the defendant’s negligence adversely affected the plaintiff.
